At Getcalley.com, we want you to have an enjoyable calling experience. And while it is necessary for us to collect certain personal information, we respect and protect your right to privacy as set forth in this Privacy Policy. This Privacy Policy applies to the Site (https://www.getcalley.com / https://app.getcalley.com / https://affiliate.getcalley.com) and our applications on Google Play Store or Apple iOS ("App"). 

This Privacy Policy does not apply to other web sites to which we link. You agree that your use of the Site and App signifies your assent to this Privacy Policy. 

If you do not agree with this Privacy Policy, please do not use the Site.

PRODUCT AND USAGE

The mobile application or the web panel or software can be used in the following manner. 

All the Calley Subscriptions "Personal", "Pro" and "Teams" will need a subscriber to access them on the Web Panel / Site (https://app.getcalley.com) as well as on the App (hosted on Android or iOS Stores).

The user makes calls on a Calling List / Contact List that can be uploaded only thru the web panel / Site via

XLS / CSV / XLSX file format.
Google Sheet Import

A Calling List / Contact List is a list of leads that the user intends to call automatically. The list cannot be loaded from the App and the App cannot sync the address book contacts of the phone with the site. 

The App allows a user to make calls and save call dispositions at the end of the call for which it needs the user to provide the following permissions:

for Android App hosted on Google Play Store 

Phone State : to make calls automatically from the mobile phone using the SIM card.
Call Logs : to ensure that the call has been disconnected and show the call disposition screen. To read calls done logs and sync duration of calls made along with the dispositions at the end of the call with the web panel / site.
Pop Over : to display the call disposition screen at the end or during the call to the user making calls. 

The user if required can use Calley ACD for the following purposes with the data stored on the Web Panel / Site and App

make calls using the mobile SIM card. 
make calls using third party providers like TextNow, Skype, Zipper or Twilio using its own accounts. 
send SMS to the lead called using the mobile phone SIM card.
send Whatsapp message to the lead using the App installed on the mobile phone. 
send emails using an email client installed on the mobile app. 
send SMS using a Twillio SMS API.  
send Email using a SMTP Server.   

INFORMATION COLLECTED

In order to access this Site, you must first complete the registration process. During the registration process, we collect personal information such as your name, phone, country of operations and email address. Once you complete and submit your registration, you have opted in to receive email communication from us.

We also collect personal information when you choose to use certain other features of the Site, such as making purchases or electing to receive text messages about upcoming  promotions or events. 

When you choose to use these additional features, we require you to provide additional personal information such as your billing and shipping addresses and credit card information, and we may request additional personal information such as your shopping preferences and demographics.

In addition, through the Site, we automatically gather certain information about the use of the Site, such as how frequently certain areas of the Site are visited, including through the use of cookies, google analytics and other technologies. Most browsers can be set to prevent cookies or to notify you when one is being placed. 

However, cookies are necessary to access the Site.

If you choose to invite an individual as an affiliate to join Getcalley.com, you will need to provide his/her name and email address. Getcalley.com stores this information to confirm qualifying orders attributable to your account and to track the results of the invitation referrals.

Name and Contact Data: We collect your name, email idm, phone number, billing address, shipping address and other identification data. 
Credentials : We collect passwords for authentication and account access. 
Payment Data : We collect data necessary for processing of payments. This includes details of your credit cards or other payment instruments. All the payments are processed thru Razorpay and Paypal payment gateway. We recommend you to read thru their privacy policies too for any queries related to data saved by payment processor.
IP Address : We collect the data for the IP Address from which you have accessed the Site and Apps.
Automatic Data Collection : This is collected by the analytics software to provide insights for device used, operating system, browser, country, demographics, language preference and other technical informations. This is primarily needed to ensure security of the Site and App, as well as for internal analytics / reporting purposes. 
Mobile App Data Collected : The app automatically collects device information (such as your mobile device ID, model and manufacturer), operating system, version information and IP address.
Mobile Device Access : We may request access or permission to certain features from your mobile device, including your mobile device’s Bluetooth, calendar, contacts, microphone, reminders, sensors, SMS messages, storage, call logs, phone state and other features. If you wish to change our access or permissions, you may do so in your device’s settings.

HOW DO WE USE THIS INFORMATION

We process your personal information for these purposes in reliance on our legitimate business interests, in order to enter into or perform a contract with you, with your consent, and/or for compliance with our legal obligations. The information collected is used for multiple purposes described below :

to facilitate account creation and logon process to use the Calley ACD. 
to send marketing, new feature and promotional communications on your email, phone or WhatsApp. 
to send administrative information to you related to your account usage. 
to fulfil and manage your orders, payments, or refunds thru the Site. 
to post testimonials on our site which might have some personal data published on the site. 
to deliver Targeted Advertising or messages to you. 
to request Feedback and Testimonials.  
to protect our site and app from unauthorised usage. 
to enforce our terms and policies.
to respond to legal requests and prevent harm. If we receive a subpoena or other legal request, we may need to inspect the data we hold to determine how to respond.
for other Business Purposes like data analytics, usage trends and to evaluate our product. 

We may permit certain trusted third parties to access your information in connection with their performance of services to maintain and operate the Site and certain features on the Site. For example, we may use third parties to host the Site; operate various features available on the Site; send emails; analyse data; provide search results; manage subscriptions; tracking of orders; processing of payments and assist in fulfilling your orders.

From time to time, we may share your personally identifiable information in connection with strategic relationships. Some of these strategic relationships may include operating a co-branded website or web pages with a strategic partner. You should be aware that these co-branded sites may collect different or additional information. Additionally, we may provide links to our Site to websites controlled by third parties. We have no control over these websites and our privacy policy does not apply to these third-party websites. Please consult the privacy policy of the website you are visiting.

Also, we may share personally identifiable or other information with our parent, subsidiaries, divisions, and affiliates.

We may transfer personally identifiable information as an asset in connection with a proposed or actual merger or sale (including any transfers made as part of an insolvency or bankruptcy proceeding) involving all or part of our business or as part of a corporate reorganisation, stock sale or other change in control.

We reserve the right to disclose information in order to comply with a subpoena, court order, administrative or governmental order, or any other requirement of law, or when we, in our sole discretion, believe it is necessary in order to protect our rights or the rights of others, to prevent harm to persons or property, to fight fraud and credit risk reduction.

We use non-personally identifiable information in the aggregate, so that we can improve the Site and for business and administrative purposes. We may also use or share with third parties for any purpose aggregated data that contains no personally identifiable information.

WILL WE SHARE THIS INFORMATION WITH ANYONE?

We will only share information with your consent to comply with laws, to protect your rights and to fulfil business obligation. Following are the instances where we disclose your information. 

to Comply with Law : We may disclose your information when we are legally required to do so in order to comply with applicable laws, government requests, judicial proceedings, court order or legal process. We may disclose your information where we believe it is necessary to investigate, prevent, or take action regarding potential violations of our policies, suspected fraud, situations involving potential threats to the safety of any person and illegal activities, or as evidence in litigation in which we are involved.
to Vendors, Consultants & Other Third-Party Service Providers : We may share your data with third party vendors, service providers, contractors or agents who perform services for us or on our behalf and require access to such information to do that work. Examples include: payment processing, data analysis, email delivery, hosting services, customer service and marketing efforts. We may allow selected third parties to use tracking technology on the Sites, which will enable them to collect data about how you interact with the Sites over time. This information may be used to, among other things, analyze and track data, determine the popularity of certain content and better understand online activity. Unless described in this Policy, we do not share, sell, rent or trade any of your information with third parties for their promotional purposes.
to facilitate Business Transfers : We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
to run Ads : We may use third-party advertising companies to serve ads when you visit the Sites. These companies may use information about your visits to our Website(s) and other websites that are contained in web cookies and other tracking technologies in order to provide advertisements about goods and services of interest to you.
to our Affiliates: We may share your information with our affiliates, in which case we will require those affiliates to honor this privacy policy. Affiliates include our parent company and any subsidiaries, joint venture partners or other companies that we control or that are under common control with us.
to our Business Partners: We may share your information with our business partners to offer you certain products, services or promotions.

We do not share or resell your information or data that you have uploaded on the Site or App.  

DEFINITIONS AND SCOPES

We use the following terms in the application and their meanings. 

Calling Agents \ Callers \ Agents \ Users

These are users who have the Calley Mobile App installed on their mobile phones and are making the calls from the devices. 

Calley Autodialer Mobile App \ App

Calley Mobile App hosted on the Google Play Store or Apple Store that can be downloaded by the user to make calls. 

Call List / Calling List / Contact List

This is the list of leads or numbers uploaded by you (in case of Calley Personal or Calley PRO Subscriptions) or by the Team Admin (in case of Calley Teams Subscription) which is available for the Calley Mobile App user to make calls from the mobile app (Android or iOS). 

Using Calley you can not load numbers from your mobile phone or upload contact list from your mobile phone.  

Call Logs

Calley mobile app reads the time between each call to find out the call duration for the calls made by the calling agents. The user who has installed the Calley App (Android) needs to accept the call duration permission so that the reporting against the calls made is generated in the Calley Web Panel. The call duration logs read are updated for the calls mode on the Calley Web Panel hosted on getcalley.com  

HOW WE PROTECT YOUR INFORMATION

We are committed to protecting the information we receive from you. We follow reasonable technical and management practices to help protect the confidentiality, security and integrity of data stored on our system. While no computer system is completely secure, we believe the measures we have implemented reduce the likelihood of security problems to a level appropriate to the type of data involved.

The Site encrypts your credit card number and other personal information using secure socket layer (SSL) technology & tokenization of credit cards to provide for the secure transmission of the information from your PC to our servers. In addition, only those employees and third parties who need access to your information in order to perform their duties are allowed such access.

LIMITED USE REQUIREMENTS FOR GOOGLE API SERVICES

Calley uses services API's provided by Google thru the Google Cloud Project for enabling access of the following services.

Google Drive Sync

Calley use information received from Google API's and will adhere to Google API Services User Data Policy, including the Limited Use requirements.  

ACCESSING AND UPDATING YOUR PERSONAL INFORMATION AND PREFERENCES

If you are a registered user, you may access and update your registration information and your preferences to receive email or other communications from us by sending an email to [email protected]. Please note that your friends and contacts may still choose to send email invitations to you. Any user who receives an email invitation to join the Site may choose not to receive such invitations in the future by following the instructions in the email invitations and, in addition, if you are a member, you may also choose not to receive such invitations by changing your preferences as indicated above. We will take commercially reasonable steps to implement your opt-out requests promptly, but you may still receive communications from us for up to ten business days as we process your request.

While we make efforts to accommodate requests to restrict our use of your information, we reserve the right to delete all or any portion of customer information if we are not able to reasonably accommodate a requested restriction.

CHILDREN’S PRIVACY AND PARENTAL CONTROLS

We do not solicit any personal information from children. If you are not 18 or older, you are not authorised to use the Site and App. Parents should be aware that there are parental control tools available online that you can use to prevent your children from submitting information online without parental permission or from accessing material that is harmful to minors.

PRIVACY POLICY CHANGES

If we decide to change our Privacy Policy for the Site, we will post the revised Privacy Policy here so that you will always know what information we gather, how we might use that information and whether we may disclose it to anyone. Your continued use of the Site indicates your assent to the Privacy Policy as posted.
